WEST DES MOINES, Iowa (AP) — The owners of a dog ordered by West Des Moines to be euthanized are appealing the decision in district court.
Reyna Gonzalez Tello and Jorge Galvan, of West Des Moines, have filed an appeal in Polk County District Court to overrule the city's declaration that the 2-year-old pit bull named Palomo and nicknamed Killer is vicious.
The owners say the city acted "illegally and unconstitutionally" by declaring the dog vicious, impounding him and ordering that he be euthanized.
The Des Moines Register says (http://dmreg.co/1erHh9T ) the dog was taken to the West Des Moines animal control facility in November following three reports of biting incidents. The dog remains alive at the facility.
West Des Moines City Attorney Dick Scieszinski told the Register that the city has not responded to the appeal.
