Third OWI for Marshalltown man

Police arrested a local man for driving while under the influence Saturday.

The OWI is the third for Francisco Garcia, 50, of Marshalltown, which bumps the charge up to a Class D felony.

Police arrested Garcia on the 400 block of Woodbury Street just before 8:30 p.m. Garcia refused a breathalyzer. He also faces driving while revoked, a serious misdemeanor, and driving under suspension, a simple misdemeanor, charges.

He is being held on $5,000 bond.

Molli Bisson, 17 1/2 N. 4th Ave., made an initial appearance on a contempt/Batterer's Education Program violation charge. The court appointed Jennifer Meyer to represent her in this case. The contempt hearing is rescheduled for 9:30 a.m. Aug. 10. Bond is set at $1,000 cash only. Following Bisson making bond, she was released on her own recognizance.

Nathan Harned, of Boone, made an initial appearance on a possession of a Schedule I Controlled Substance charge and a possession of a drug paraphernalia charge resulting in probation violation charges. The public defender's office was appointed to handle his cases. The preliminary hearing is set for 1 p.m. July 20. The probation revocation hearing is set for 2:30 p.m. July 18. Bond is set at $3,000 total cash or surety.

Kerry Logan, 408 W. High St. Lot #18, made an initial appearance on a public intoxication charge. He pleaded guilty and was fined $65 with a $22.75 surcharge and $60 in court costs for a total of $147.75, due by Aug. 8.

Derick Bryan, 502 E. Main St. Apt. #2, made an initial appearance on a theft, third degree charge. The public defender's office was appointed to handle his case. The preliminary hearing is set for 1 p.m. July 20. Bond is set at $2,000 cash or surety.

Jamell Goodman, of Melbourne, made an initial appearance on a interference with official acts charge and a disorderly conduct charge. She pleaded not guilty and a pre-trial conference is set for 9 a.m. Aug. 7 in Magistrate Court. Goodman was released on her own recognizance.

Mary Sheeley, 502 E. Main St. Apt. #2, made an initial appearance on a theft, third degree charge. The public defender's office was appointed to handle her case. The preliminary hearing is set for 1 p.m. July 20. Bond is set at $2,000 cash or surety.

Yolanda Rowley, 906 W. Main St. Apt. #1, made an initial appearance on a introducing contraband into the jail charge and a disorderly conduct charge. The public defender's office was appointed to handle her cases. The preliminary hearing is set for 1 p.m. July 30. Rowley was released through the Department of Correctional Services and is to contact them within 48 hours. The court ordered that she obtain a substance abuse evaluation and submit the results to the court within 60 days.

Edwardo Eddie Gonzalez, 502 N. 1st Ave., made an initial appearance on a curfew violation charge. He pleaded guilty and was fined $65 with a $22.75 surcharge and $60 in court costs for a total of $147.75, due immediately.

Joshua Voss, 202 N. 12th St., made an initial appearance on a public intoxication/enhanced charge. The public defender's office was appointed to handle his case. The preliminary hearing is set for 1 p.m. July 30. Voss was released on his own recognizance following a court order to photograph and fingerprint him. The court further ordered that he obtain a substance abuse evaluation and submit the results to the court within 60 days.

Russell Taylor, of Hickory, N.C., had a motion to continue the case of improper use of lanes brought before the court. The court ordered that the case be continued to 9 a.m. Dec. 11 in Magistrate Court.

Blake Matney, of Liscomb, had the case of a bonfire at his residence that caused alarm to neighbors brought before the court and a trial date was set for 9 a.m. Aug. 10.

Johnny Seed, of Toledo, a case of driving while license is denied, cancelled, revoked or suspended was brought to the court and a pre-trial conference is set for 9 a.m. Oct. 3.

Kaily Lynett Beeghly, 207 S. 8th Ave., made an initial appearance on a driving while license is denied, cancelled, revoked or suspended charge. She pleaded guilty and was fined $250 with a $87.50 surcharge and $60 in court costs for a total of $397.50, due immediately.

Lisa Hurd, of Albion, made an initial appearance on a dog at large charge. She pleaded not guilty and a pre-trial conference is set for 9 a.m. Aug. 14.

Glenda Anita Schmidt, 303 S. 1st St. Apt. #1, made an initial appearance on a theft, fifth degree charge. The court appointed Laura Sopher to represent her in this case. She pleaded not guilty and a pre-trial conference is set for 9 a.m. Aug. 14. Schmidt was released on her own recognizance.

Rickey James Wilkening, of State Center, made an initial appearance on a operating while intoxicated, first offense charge and a driving on the wrong side of a two-way highway charge. The preliminary hearing is set for 1 p.m. July 30. Wilkening was released on his own recognizance. The court ordered that he obtain a substance abuse evaluation and submit the results to the court within 30 days.

Rebecca Lynette Carson-Lopez, 1106 1/2 W. Church St., made an initial appearance on a underage possession of alcohol charge. She pleaded guilty and was fined $200 with a $70 surcharge and $60 in court costs for a total of $330, due immediately.

On Monday, an employee with Brown's Auto Repair, 1710 S. 4th St., reported the theft of a Lincoln arc welder, a Century wire welder and tool from 806 Maytag Road. Estimated value of loss was $495.

On Sunday, Robert James Doran, 713 Union St., reported the theft of an air compressor from his residence. Estimated value of loss was $250.

On Sunday, Jill Lynn Simatovich, 1410 W. State St., reported the theft of a golf and diamond engagement ring and a mother's birthstone ring from her residence. Estimated value of loss was $1,650.

On Sunday, Maria Perez Busani, 1301 E. Boone St. (Half), reported the theft of a Sony Vizio 42 inch flatscreen TV and a video recording/surveillance system. Estimated value of loss was $800.

Accidents

On Saturday, a car driven by Nathan Lee Markwell, 507 W. Boone St., was turning from West Main Street onto North 17th Street when the driver realized it was a dead-end street and backed out onto West Main Street and collided with a vehicle driven by Fidel Sanchez, 305 N. 4th St., which was traveling east on Main Street. No injuries were reported. Markwell was cited for no insurance while Sanchez was cited for driving on the wrong side of a two-way highway. Damage to both vehicles was estimated at $1,000 each.

On Tuesday, a minivan driven by Amanda Jean Rhodes, 2001 Wallace Ave. Apt. C, was backing up in a private parking lot at 704 May St., when it struck a fixed light pole owned by Alliant Energy, 1911 E. Anson St. No injuries were reported. Damage to the Rhodes minivan was estimated at $2,000.

On Monday, a car driven by Darlene Mildred Hanner, 915 W. Merle Hibbs Boulevard Unit #20, was northbound on the Frontage Road when it left the stop sign at the intersection with Merle Hibbs Boulevard and collided with a minivan driven by Martha Rebecca Browns, of Conrad, which was traveling westbound on Merle Hibbs. No injuries were reported. Hanner was cited for failure to obey a stop sign. Damage to the Hanner car was estimated at $2,500 while the Browns minivan received an estimated $3,000 in damage.

On Monday, a car driven by Melissa Rose-Marie Hall, 1513 Brentwood Terrace, was southbound on South Center Street approaching the intersection with Olive Street when it collided with the rear of a pickup driven by Scott Alan Kelber, of Rhodes, which had slowed for traffic in front. No injuries were reported. Hall was cited for driving while license is denied, cancelled, revoked or suspended; failure to stop within a safe and sure distance and no insurance. Damage to the Hall car was estimated at $2,000 while the Kelber pickup received an estimated $750 in damage.
