Local man faces vehicular homicide for Sept. ATV crash

Police have charged the alleged driver of an ATV that crashed in September, killing a local teen.

Derick Bear, 18, of Marshalltown, faces vehicular homicide, a Class C felony, after he allegedly drove recklessly with 14-year-old Mario Ortega on the back, said Capt. Mike Hanken, with the Marshalltown Police Department.

Police arrested Bear Tuesday.

Ortega was not wearing a helmet when the crash flung him from the ATV in a grassy area near Marion Street and 10th Avenue.

Ortega's injuries later killed him after paramedics transported him to Taylor House Hospice in Des Moines.

A Class C felony is punishable by up to 10 years in prison and up to $10,000 in fines.
