Man flashes gun behind the wheel, follows victims home

A man who was allegedly driving recklessly, showed a gun to a driver and passenger in another car, then followed them home, was arrested at gunpoint.

Joshua James Lyster, 38, of Ames, was arrested Sunday on the 300 block of North First Street, for the incident that happened on Iowa Avenue.

According to police, one of the victims called officers after they saw a gun Lyster showed them. An officer went to the victims' house before they arrived to make sure they were safe.

Shortly after police arrived, Lyster was found in an alley behind the victims' house and was arrested after officers found a handgun in his car.

Lyster was charged with carrying weapons, an aggravated misdemeanor and sent to jail.

Jimmy Allen Austgen, 609 E. Main St., made an initial appearance on a theft-third degree charge, two counts of a forgery charge and a possession of methamphetamine with the intent to deliver charge. The public defender's office was appointed to handle his case. The preliminary hearing is set for 1 p.m. on Dec. 13. Bond is set at $105,000 cash or surety on all charges.

Brandon Lee Schmidt, 1306 W. Linn St., made an initial appearance on a domestic abuse assault-strangulation charge and a obstruction of emergency communications charge. The public defender's office was appointed to handle his case. The preliminary hearing is set for 1 p.m. on Dec. 13. Bond is set at $5,000 cash only. The court ordered that if he owned or possessed any firearms or ammunition, Schmidt is to contact the Marshall County Sheriff's Office within 24 hours to make arrangements to surrender them. A no-contact order was issued for the protected party.

Jason Allen Darter, 3202 S. 12th St. Lot #125, made an initial appearance on a domestic assault charge and a interference with official acts charge. The public defender's office was appointed to handle his case. The preliminary hearing is set for 1 p.m. on Dec. 13. Bond is set at $1,000 cash only. The court ordered that if Darter owned or possessed any firearms or ammunition he is to contact the Marshall County Sheriff's Office within 24 hours to make arrangements to surrender them. A no-contact order was issued for the protected party.

Ashley Marie Campbell, 3108 S. Center St. Room #125, made an initial appearance on a theft-fifth degree charge. She pleaded not guilty and a pre-trial conference is set for 9 a.m. on Dec. 31 in Magistrate Court. Bond is set at $300 cash or surety. The judge ordered that she be photographed and fingerprinted by the Marshalltown Police Department by the end of work today.

James Richard Cuellar, address unknown, made an initial appearance on a failure to appear for a probation revocation hearing charge. Norma Meade will remain as counsel. The District Court will reschedule Cuellar's probation revocation hearing as its docket permits. Bond is set at $5,000 cash only.

Larry E. Gwinn, of Le Grand, made an initial appearance on a failure to appear for a possession of drug paraphernalia hearing charge and a possession of marijuana charge. On the possession of drug paraphernalia charge Gwinn pleaded not guilty and a pre-trial conference is set for 9 a.m. on Dec. 31 in Magistrate Court. On the possession of marijuana charge the public defender's office was appointed to handle his case. The preliminary hearing is set for 1 p.m. on Dec. 13. Bond is set at $1,300 cash or surety on all charges. Upon release Gwinn is required to obtain a substance abuse evaluation and submit the results to the court within 60 days.

Nicole Lynn Roberts, 105 S. Fifth St., made an initial appearance on a simple assault charge. She pleaded not guilty and a pre-trial conference is set for 9 a.m. on Dec. 31 in Magistrate Court. Roberts was released on her own recognizance. A no-contact order was issued for the protected party.

Loren Strickler, address unknown, made an initial appearance on a public intoxication charge. He pleaded guilty and was fined $65 with a $22.75 surcharge and $60 in court costs for a total of $147.75. The court allowed monthly installment payments of $50 beginning Jan. 3, 2014 until the debt is paid in full.

Jessie Bryce Calvert, of Montour, made an initial appearance on a serious assault charge and two counts of a violation of a no-contact order charge. The public defender's office was appointed to handle his case. The preliminary hearing is set for 1 p.m. on Dec. 9. Bond is set at $1,000 cash only. If bond is secured, Calvert is released through the Department of Correctional Services.
