Easement and right of way
I was told in no uncertain terms that because May St. is platted at 66 feet wide myself and the other homeowners on May Street do not own the size of land shown on our deeds. It is more than an easement to access the property; it is actually city property. That means several homes
on the street essentially have minute front yards. We maintain our entire properties and pay taxes on them, but our deeds are not correct. Aerials of our property and assessors’ print outs show it is our property but it is not. That would mean we all need deed correction through no fault of our own. It was never disclosed to us. We need an answer. Does all of the 33 feet each direction from the center of the street belong to the city or is it partly an easement? It can’t be both legally. We do not own expensive properties but that does affect the value. It’s hard to
sell a house with no front yard as listed on the deed. We look forward to a respectful and correct answer. How many other streets in town have the same situation? Did the city allow homes to be built without proper set backs or was the oversize street platted after the fact?
